Real Estate Solutions

Real estate is one of York Howell & Guymon’s core disciplines and our attorneys provide clients with effective and economical solutions in a full range of real property and land use issues.

Purchase, Sale, and Finance
York Howell & Guymon attorneys assist clients as both sellers and purchasers in real estate transactions of all types and sizes. Our clients rely on us to help them navigate the various issues that are unique to real estate transactions. In addition, our real estate group helps facilitate real estate transactions by providing counsel to lenders and borrowers in real estate-secured lending transactions.

Leasing and Landlord / Tenant
We represent both landlords and tenants in all types of commercial and residential leasing transactions. We negotiate and structure lease transactions and draft lease documents that protect our clients’ interests and provide long-term clarity and stability.

Land Use, Construction, and Development
Our attorneys have extensive experience assisting clients with real estate development. We work closely with, and regularly appear before, local land use and zoning authorities to obtain necessary permits and other approvals. Once property is entitled, we assist our builder and developer clients at various stages of the construction process by drafting contracts and subcontracts, addressing bonding and mechanics lien issues, and advising contractors in employment and regulatory matters.

Eminent Domain
York Howell & Guymon assists clients dealing with eminent domain issues by insuring that they receive due process and just compensation from condemning authorities.

Real Estate Professionals
We represent Utah’s real estate professionals in a broad range of matters, including employment issues, commission disputes, and matters before the Utah Division of Real Estate.

Real Estate Litigation
The real estate attorneys at York Howell & Guymon vigorously prosecute and defend real estate disputes of all types. We regularly handle disputes involving purchase and sale transactions. We represent both landlords and tenants in leasing disputes. We litigate boundary disputes, easements, and access issues. In title and priority disputes we have obtained successful outcomes for both title companies and claimants. We represent lenders in foreclosure and post-foreclosure matters. In the construction context, our attorneys have experience litigating payment disputes, including Miller Act and Little Miller Act matters, and design and construction defect cases. Regardless the nature of the dispute, we work closely with our clients to identify their litigation goals and to develop cost-effective approaches to reach those goals.
